Kansas Law on Leaving the Scene of an Accident

Kansas law is clear about what a driver must do after a crash. Under K.S.A. 8-1602, any driver involved in an accident that causes injury, death, or damage to an attended vehicle or property must stop immediately at the scene, or as close to it as possible, and remain there until all legal duties are fulfilled. K.S.A. 8-1604 goes further, requiring that driver to provide their name, address, and vehicle registration to other parties and to render reasonable aid to anyone who is injured. Reasonable aid can include calling 911 or helping transport an injured person to the nearest hospital.

Violating these duties carries serious consequences. Leaving the scene is a misdemeanor when property damage is under $1,000, a class A person misdemeanor when injury occurs or damage reaches $1,000 or more, and a severity level 3 or 4 person felony when the driver knew or should have known the crash caused a death. The criminal penalties don’t compensate you for your injuries, but they do establish that the law treats this conduct seriously, and that matters in a civil claim.

How Kansas Hit-and-Run Victims Recover Compensation

The unidentified driver can’t be sued directly, but Kansas law creates coverage options that apply precisely in this situation. K.S.A. 40-284 requires every auto insurance policy issued in Kansas to include uninsured and underinsured motorist (UM/UIM) coverage.
